Bogus use of the Hatch Act

My Democrat opponent and his handlers within the Democratic Party are attempting to use a highly technical and arcane federal law passed in the late 1930s to deceptively insinuate that I am not permitted to campaign for the Utah House of Representatives.

The act, in effect since 1940, applies to state and local employees who work in an executive branch of government that receives certain types of federal money, such as Head Start or community block grants, said Amber Bell, an attorney with the Hatch Act Unit in the Office of Special Counsel….The act only prohibits campaigning, not holding the office, Bell said. (LAS VEGAS SUN, 10.10.2003)

As Ogden’s Chief Technology Officer, I am paid by and manage the Information Technology Division, which provides computer, telephony, and other technical services to the City’s Departments and Divisions. The IT Division is funded through an “Internal Service Fund”, which does not receive any direct assistance or funding from the Federal Government, nor directly administer nor directly control any grant funding or funded program.

Simply put: Individuals who have no direct duties in connection with federally funded activities are not covered by the Hatch Act.

In reality this is simply a desperate and futile attempt by my opponent and his Democratic Party handlers to divert attention away from his record as an ineffective legislator.

I had hoped that this campaign would focus on ideas and Utah’s future. I have presented my ideas openly on this website and elsewhere; I had hoped that my opponent would do the same. I will not stoop to political dirty tricks. I believe in the voters of District 35 and do not believe they can be taken in by such tactics.
